Here at Nido Estates, we are by your side at every step of the process, giving you a stress-free buying experience.

The 10 Steps To Buying a Property in Spain

Step 1: Secure Your NIE

Every individual in Spain possesses a unique identification number, and yours is no exception. The NIE, or Número de Identificación de Extranjeros, is your key to unlocking everyday Spanish life, from opening a bank account to purchasing your dream property. You can obtain your NIE in person, through a representative in Spain, or via your local Spanish consulate.

Step 2: Enlist Expert Guidance

A knowledgeable lawyer and financial expert are essential assets in your property-buying adventure. Seek a reputable lawyer fluent in your language, specialising in property and land transfers. They’ll navigate the legal and tax intricacies and ensure your interests are always protected. Additionally, consult with a financial advisor to secure a mortgage or financing, if needed.

Step 3: Open a Spanish Bank Account

Making financial transactions in Spain is simplified with a local bank account. While free banking is uncommon, compare banks to find the best option for your needs or look to the growing number of online banks. Consider opening an account with your mortgage provider for added convenience.

Step 4: Embark on Your Property Quest

With a clear vision of your desired location, purpose, and type of property, the fun begins in finding your perfect Spanish abode. Thoroughly research your chosen area and the property itself before viewing and making an offer. Arrange to view the properties and visit the area before negotiating the best price.

Step 5: Reserve Your Dream Home

The Contrato de Reserva, or reservation contract, secures your desired property, taking it off the market for a specified period while you complete due diligence and finalise financing. You’ll need to pay a holding fee of around €3,000 to €6,000, which will be held in escrow and either returned or deducted from your deposit. Remember to include exit clauses in the contract to safeguard your holding fee in case of unexpected circumstances.

Step 6: Conduct Due Diligence and Finalise Financing

Before committing, meticulously check the property’s legal status, including land registry and catastro checks, verifying that it possesses the necessary permits and licences, confirming the absence of outstanding debts, and reviewing the community of owners documents. Engage a professional property inspector to assess the condition of the property. If financing is required, finalise your mortgage arrangements.

Step 7: Seal the Deal with Deposits and Contracts

The “Contrato de Arras,” or deposit contract, formalises your commitment to purchase the property. Within 10 days, you’ll pay a 10% deposit. Following legal checks, you’ll sign the “Contrato Privado de Compraventa,” the Private Purchase Contract, outlining the sale conditions. This contract obligates the buyer to complete the purchase or forfeit their deposit. Conversely, if the seller withdraws, they typically compensate the buyer with double the deposit. Cash buyers may bypass this step and proceed directly to the Purchase Contract, signed at the Notary.

Step 8: Officialization at the Notary Office

The culmination of your property-buying journey takes place at the Notary Office, where all parties involved—buyer, seller, legal representatives, and mortgage provider—gather for the final exchange of documents and payments. Ensure you fully understand the financial implications, including taxes and fees, and have sufficient funds available.

Step 9: Connect Utilities and Celebrate

Switch utility bills and service providers under your name, enabling you to manage your accounts and explore alternative, more cost-effective options.

Step 10: Celebrate Your Spanish Achievement

Congratulations! You’ve successfully navigated the property-buying process and now own a piece of Spain. Take a moment to relish your accomplishments before immersing yourself in the wonders of your new home or investment property. ¡Enhorabuena!
